Introduction: The Impact of Marriage to a Turkish Citizen on Foreign Status

In the Turkish legal system, the marriage of a foreign national to a Turkish citizen does not automatically grant the foreign spouse a residence permit, the right to work, or Turkish citizenship in Türkiye. Rather than creating an absolute status in favor of the foreign spouse, the establishment of the marital union acts as a legal prerequisite that provides the legal capacity to apply to the relevant administrative authorities. In Türkiye, marriage-based foreign status is built upon a tripartite legal regime subject to independent normative rules, different administrative authorities, and separate judicial review mechanisms.

Legal Framework and Fundamental Paradigm: Absence of Automatic Rights and the Tripartite Regime Distinction

When examining the legal status of foreigners married to Turkish citizens in Türkiye, it is seen that the right of residence is governed under the Law on Foreigners and International Protection No. 6458 (LFIP/YUKK) administered by the Presidency of Migration Management; the acquisition of citizenship is governed under the Turkish Citizenship Law No. 5901 (TCL/TVK) under the purview of the Directorate General of Civil Registration and Citizenship Affairs (NVİ) and the Ministry of Interior; and the right to work is regulated under the International Workforce Law No. 6735 (IWL/UİK) administered by the Ministry of Labor and Social Security. The most common losses of rights encountered in practice stem from the assumption that these three separate administrative processes are natural extensions or automatic results of one another. For instance, holding a family residence permit does not grant the foreign spouse the right to work, nor does having submitted a citizenship application eliminate the foreign spouse's obligation to extend their existing residence permit.

Validity of Marriage and Obligation of Registration

For a foreign spouse to apply for either a family residence permit or Turkish citizenship, the prerequisite is that the marriage must be established through an official civil marriage ceremony that is valid both substantively and formally under Turkish law. Religious marriage ceremonies or de facto unions not recognized under Turkish law do not generate any administrative rights.

The validity of the marriage is determined according to the provisions of the Code on Private International Law and Civil Procedure No. 5718 (MÖHUK). Marriages solemnized abroad before foreign local authorities are also valid in Türkiye, provided they do not violate Turkish legislation and public order. However, for these marriages to take effect in administrative processes, they must be reported to Turkish foreign representations or registered in the MERNİS records at civil registration directorates in Türkiye. Unless a foreign marriage is registered, the commencement of the 3-year citizenship application period or the submission of a family residence application may lead to practical disruptions. Furthermore, marriage and marital status documents obtained from foreign authorities must bear an Apostille certification and be translated by a sworn translator and notarized in Türkiye.

Family Residence Permit Regime: Conditions and Exceptions

Foreign spouses who will stay in Türkiye beyond their visa or visa exemption period are legally obliged to obtain a residence permit. The most advantageous and primary residence status available to foreigners married to Turkish citizens is the Family Residence Permit, regulated under Articles 34 to 37 of Law No. 6458 (YUKK). Under this permit, while the Turkish citizen spouse holds the title of 'sponsor' (supporting person), the foreign spouse, the minor (under 18) foreign child of the foreign spouse or sponsor, and their dependent adult foreign child may be beneficiaries of the permit.

A family residence permit may be issued for periods not exceeding 3 years at a time and may be extended as long as the marital union continues. However, the validity period of the passport constitutes a critical upper limit. Even in cases where polygamous marriage is valid under the foreigner's national law, pursuant to Turkish public order and Article 34/2 of YUKK, a family residence permit may be granted to only one spouse; however, all foreign children from other spouses may benefit from the family residence permit. Furthermore, children holding a family residence permit have the right to receive education in primary and secondary educational institutions until the age of 18 without obtaining a separate student residence permit.

Legal Criteria for the Sponsoring Turkish Spouse and the Applicant Foreign Spouse

To issue a family residence permit, the legislator has stipulated cumulative conditions in Article 35 of YUKK for both the sponsoring Turkish spouse and the applicant foreign spouse. The first fundamental requirement sought for the sponsoring Turkish spouse is the income standard. Since as of 2026 the net minimum wage is 28,075.50 TL and the one-third per capita threshold is 9,358.50 TL, a regular monthly income varying according to the number of family members is required. Although official document lists of the Presidency of Migration Management state that a 'written declaration of income' is considered sufficient if the sponsor is a Turkish citizen, Provincial Directorates of Migration Management demand concrete substantiating documents—such as e-signed payrolls, SSI (SGK) service records, pension documents, or bank account statements—especially in extension applications.

In addition to the income criterion, valid health insurance and accommodation conditions meeting general health and safety standards are mandatory. If the Turkish spouse is covered by the Social Security Institution (SGK), an e-signed/stamped healthcare entitlement (provizyon) document obtained from SGK covering the foreign spouse as a dependent satisfies this condition. Furthermore, the sponsoring spouse must document that they have not been convicted of 'crimes against family order' within the last 5 years prior to the application date and must be registered in the MERNİS Address Registration System. A foreigner marrying a Turkish citizen can apply for a family residence permit immediately after the official wedding ceremony within their legal stay period.

As for the applicant foreign spouse, they are required to demonstrate that they live or intend to live with the sponsor, that the marriage was not entered into solely for the purpose of obtaining a residence permit, that they do not fall within the scope of Article 7 of YUKK (persons who shall be refused entry into Türkiye), and that both spouses have reached the age of 18. Even if a person aged 16 or 17 can enter into a valid marriage under the Turkish Civil Code, they cannot obtain a family residence permit until they turn 18.

Inspection of Marriages of Convenience and Critical Exemptions in Administrative Practice

Before granting a family residence permit or after it has been granted, the administration has the authority to inspect whether the marriage is a marriage of convenience (sham marriage) entered into solely to obtain a residence permit. If there is a ground for suspicion, law enforcement officers conduct unannounced address checks without violating the privacy of private life and the inviolability of the domicile, gather information from neighbors and local authorities, and interview the spouses separately and together at the Provincial Directorate of Migration Management. If the investigation reveals that the marriage is one of convenience, the family residence permit is rejected or canceled if already granted, a V-70 restriction code imposing a 5-year entry ban into Türkiye is processed against the foreigner, and periods spent in Türkiye under this permit are never counted toward the aggregation of periods for long-term residence or citizenship.

The two most important administrative privileges enjoyed by foreigners married to Turkish citizens compared to other foreign groups are the exemption from closed neighborhood restrictions and the opportunity to transition to legal status in cases of visa violations. Together with an official marriage certificate, the foreign spouse can register at the Turkish spouse's MERNİS address located in a closed neighborhood and obtain a family residence permit. Additionally, one of the exceptional channels through which foreigners who legally entered Türkiye with a valid passport and subsequently fell into irregular status can acquire legal status without leaving the country is 'family reunification with a Turkish spouse.' Similarly, holders of Temporary Protection Identity Documents can apply for citizenship by marriage by entering into an official marriage with a Turkish citizen.

Residence Status in Crisis Scenarios (Divorce, Death, etc.)

In crisis scenarios where the marital union is shaken or terminated by divorce or death, the residence status of the foreign spouse in Türkiye is bound to special transition rules pursuant to Article 34/5, 6, 7 and Article 31/1-ğ of YUKK. While a divorce lawsuit is pending in court, since the marital union has not legally ended, the existing family residence permit remains valid, and an extension application can be filed when the permit expires. However, once the divorce decree becomes final, the legal basis of the family residence permit ceases to exist. If the foreign spouse remained married to a Turkish citizen and resided in Türkiye with an uninterrupted family residence permit for at least 3 years, they can transition to a Short-Term Residence Permit following the divorce. Only actual periods spent under a family residence permit are included in the calculation of this 3-year period.

The legislator introduced an absolute protection exception to prevent the foreign spouse from being forced to remain in an abusive marital environment merely to avoid losing their residence permit. If it is established by a relevant court decision that the foreign spouse is a victim of domestic violence, they are granted the right to transition to a short-term residence permit without requiring the condition of having resided on a family residence permit for 3 years. Similarly, in the event of the death of the sponsoring Turkish spouse, the foreign spouse and foreign children may apply for a short-term residence permit without being subject to any duration requirement. Furthermore, foreign children who have resided in Türkiye with a family residence permit for at least 3 years may convert their permits into a short-term residence permit upon request when they turn 18.

Access to the Labor Market: Exceptional Work Permit and Its Relationship with Residence

A family residence permit only grants the foreign spouse the right of legal residence in Türkiye; on its own, it does not provide the right to work dependently for an employer or independently. Working without a work permit or exemption creates the risk of both administrative fines and the cancellation of the existing family residence permit on grounds of 'use outside its purpose' and suspicion of a marriage of convenience. Conversely, a valid work permit simultaneously substitutes for a residence permit. Therefore, a foreign spouse who obtains a work permit does not need to separately obtain or extend a family residence permit.

Pursuant to Article 16, Paragraph 1, Subparagraph (g) of the International Workforce Law No. 6735, foreigners who are 'married to a Turkish citizen and living in a marital union with their spouse in Türkiye' are included within the scope of the Exceptional Work Permit. This status provides major structural conveniences to the foreign spouse and the prospective employer compared to the standard work permit regime. The quota, financial adequacy, and high wage criteria required in standard foreign work permit applications are, as a rule, not applied to exceptional work permit applications of foreigners married to Turkish citizens. Moreover, in applications filed on behalf of a foreigner living in a marital union in Türkiye with a Turkish citizen for at least 3 years, the work permit can be issued directly for up to 3 years.

Acquisition of Turkish Citizenship by Marriage: Administrative Investigation and Judicial Review

The acquisition of citizenship by foreigners married to Turkish citizens is conducted within the framework of Article 16 of the Turkish Citizenship Law No. 5901 and its Implementation Regulation. Pursuant to Articles 10/1 and 16/1 of the Law, marriage does not directly grant citizenship to a foreigner; even if all statutory conditions are fully met, this does not confer an absolute right upon the individual, and the final decision is subject to the discretion of the Ministry of Interior.

Prerequisites, Substantive Conditions, and Strategic Advantages over General Acquisition

Acquisition of citizenship by marriage provides the applicant with crucial procedural and substantive exemptions compared to general acquisition of citizenship. Uninterrupted residence in Türkiye is not required, Turkish language proficiency is not a statutory condition, and income and profession criteria are not sought. To qualify for application under Article 16/1 of TVK, the prerequisites are that the foreigner has been married to a Turkish citizen for at least 3 years and that this marriage is still continuing at the time of application (and decision). If the applicant's spouse acquired Turkish citizenship after the date of marriage, the starting point of the 3-year period is not the wedding date, but the date the spouse acquired Turkish citizenship.

For a foreign spouse meeting the prerequisites, three substantive conditions are cumulatively sought under Article 16/1 of TVK: the condition of 'living within a family union,' the foreign spouse 'not engaging in any activity incompatible with the marital union,' and 'not having any circumstance that constitutes an obstacle with respect to national security and public order.'

Investigation Process, Cross-Interviews, and Security Clearance Dynamics

An application for citizenship by marriage is submitted in person or via special power of attorney to the governorate of the province of residence (Provincial Directorate of Civil Registration and Citizenship Affairs) for those residing in Türkiye, and to Turkish foreign representations (Embassy/Consulate) for those living abroad. A five-stage administrative investigation chain operates from receipt of the application to its final determination. During this process, spouses are subjected to cross-interviews both separately and together. The aim of the interview is not to test rote memorization, but to inspect the suspicion of a sham marriage by measuring the consistency of statements with each other and with the documents in the file. The Ministry of Interior evaluates all findings from the investigation, commission interview, and archive research as a whole and issues an approval or rejection decision.

Criminal Records and Limits of Discretionary Power in Light of Council of State Jurisprudence

Decisions by the Ministry of Interior rejecting citizenship applications are not final and may be challenged through an action for annulment before the Ankara Administrative Courts—where the Ministry that issued the act is located—within 60 days following the date of written notification. In the decisions of the Council of State (Danıştay), there are fundamental jurisprudential principles that limit the administration's discretionary power. For instance, the flexible and purposive interpretation of the concept of 'living within a family union' aims to protect spouses who are in different locations due to compulsory reasons. It has also been established by judicial rulings that the criminal record of the Turkish citizen spouse cannot be used as grounds for rejecting the foreign spouse's citizenship application.

Death, Divorce, Nullity of Marriage, and Status of Minor Children

The manner and timing of the termination of the marital union produce directly determinative consequences on the acquisition and retention of citizenship. If the Turkish citizen spouse passes away before the application date, the foreign spouse does not acquire the right to apply under Article 16 of TVK. However, if the marriage ends due to the death of the Turkish citizen spouse after the 3-year period has elapsed and the citizenship application has been submitted, the requirement of 'living within a family union' is waived. In divorce cases, a divorce occurring before the application or while the application is under review eliminates the condition of continuation of marriage, leading to the rejection of the application. Conversely, divorcing after acquiring Turkish citizenship by marriage does not cause the loss of Turkish citizenship. In the event of a ruling of absolute or relative nullity of marriage, the foreign spouse retains Turkish citizenship if it is determined that they acted in good faith in entering the marriage. Children born of a marriage declared null and void retain their Turkish citizenship under all circumstances, even if their parents did not act in good faith.

Strategic Assessment and Administrative Judiciary Perspective

The legal status in Türkiye of foreign nationals married to Turkish citizens is shaped by a delicate balance between constitutional guarantees protecting family integrity and public order measures aimed at preventing irregular migration and sham marriages. For the sound conduct of administrative processes and the prevention of irreparable losses of rights, the synchronization of processes, the substantiation of cohabitation with concrete evidence, and the timely activation of effective judicial protection mechanisms against rejection/cancellation decisions are of decisive importance.

Immediate registration of marriages solemnized abroad into MERNİS via foreign representations or civil registration directorates is mandatory for both the family residence permit and the legal running of the 3-year citizenship period. Foreign spouses living in Türkiye must extend their family residence permits before expiration while their citizenship application review is ongoing and must submit their complete UETS (National Electronic Notification System) addresses obtained from PTT in their extension files. The Residence Permit Application Document issued upon completion of a residence application provides legal stay in Türkiye until a decision is rendered and, together with fee receipts, grants the right to multiple exits and entries for periods not exceeding 15 days each time. In both family residence inspections and citizenship investigations, the administration looks for traces of shared life beyond abstract declarations. Exact alignment of the spouses' MERNİS records with the shared residence where they actually live, up-to-date utility bills and lease agreements, joint bank account transactions, and SGK healthcare entitlement records are the strongest pieces of evidence dispelling suspicion of sham marriage. When temporary separate living arrangements occur due to work, education, or health reasons, submitting official documents proving these justifiable grounds to the file during the investigation stage prevents a potential rejection decision.

Finally, filing a lawsuit with a request for a stay of execution before the Administrative Court within 60 days of notification against decisions rejecting or canceling a family residence permit, and filing an annulment lawsuit before the Ankara Administrative Courts within the 60-day peremptory period against citizenship rejection decisions while requesting the court to subpoena all investigation, commission interview, and archive research records pursuant to Article 20 of the Administrative Trial Procedure Code (İYUK), are of vital importance for the judicial review of the legality of the administration's discretionary power. Submitting a new citizenship application directly without eliminating the reason for rejection neither restores the missed 60-day litigation period nor avoids a repeated rejection on the very same grounds.
